Terms of service
Effective July 16, 2026These Terms of Service are a binding agreement between you and Vignelli Technik LLC, the company that operates parq ("parq," "we," "us," or "our"). Please read them carefully — they include an arbitration agreement and a class-action waiver (see the Dispute Resolution and Arbitration section) that affect how disputes are resolved. By using parq, you agree to these Terms and to our Privacy Policy.
1. Acceptance of terms
You must be at least 18 years old and able to form a binding contract to use parq. By verifying your number, paying for parking, or otherwise using the service, you accept these Terms and our Privacy Policy. If you do not agree, do not use parq.
2. The service
parq lets you pay for parking at participating properties from your phone. When you pay, you buy the right to park one vehicle, identified by the plate you enter, in the zone you selected, until the end time shown at purchase and in your confirmation text. parq is a payment and session-management platform; the properties own, operate, and enforce their own lots.
3. Your account
Your mobile number is your identity on parq. Keep access to it secure, and let us know if you lose control of it. You are responsible for activity under your number. Use one account per person. Partner, accountant, and validator logins are for authorized business users of the properties they belong to.
4. How parking sessions work
Enter your plate accurately — a mistyped plate can result in enforcement action by the property even though you paid. Park within the zone you purchased. Move your vehicle or extend your session before it expires; you can extend from the link in your confirmation text. Session times are shown in the property's local time zone.
5. Payments
Rates are set by each property and shown before you pay. All charges are in US dollars and are processed by Stripe. If you choose to save a card, you authorize us to store it with Stripe for faster checkout and to charge it for parking you initiate; you can remove a saved card at any time from your account.
6. Refunds
Parking sessions are not refundable once started, except in two cases: (1) when a business validates or comps your parking, in which case the charge is refunded in full; or (2) when the property authorizes a refund. Extensions follow the same rule. Partial time is not prorated. Billing questions should start with compliance@parq.live; we respond within a reasonable time.
7. Billing disputes and chargebacks
If you believe a charge is wrong, contact compliance@parq.live before disputing it with your bank so we can resolve it quickly. Filing a chargeback for a valid parking charge is a breach of these Terms and may result in suspension of your account.
8. SMS and text-message consent
By providing your mobile number and checking the consent box, you agree to receive text messages from parq: one-time login codes and transactional parking notifications (payment confirmations, expiry reminders, extension links, and validation notices). Message frequency varies. Message and data rates may apply. Reply STOP to opt out of parking notifications or HELP for help. Consent to receive parking notifications is not a condition of purchase; login codes are sent only when you request them to sign in. We do not send marketing texts.
9. Acceptable use
Do not use parq to defraud a property or parq, spoof or misrepresent a plate, gain unauthorized access to accounts or data, interfere with or overload the service, reverse engineer or scrape it, or use it for any unlawful purpose.
10. Enforcement and citations
Properties enforce their own lots. An expired or unpaid session may result in a citation, towing, or booting under the property's posted rules. parq provides properties with payment status by plate; parq does not issue citations and is not responsible for a property's enforcement decisions. Disputes about a citation are between you and the property.
11. Property partners
Properties that use parq set their own zones and rates and are responsible for the accuracy of those rates, for enforcing their lots, for their applicable taxes, and for the conduct of their staff and validators. The commercial relationship between parq and a property is governed by a separate partner agreement. Nothing in these Terms makes parq responsible for a property's obligations.
12. Intellectual property
parq, including its software, design, and brand, is owned by Vignelli Technik LLC. We grant you a limited, non-exclusive, non-transferable, revocable license to use the service for its intended purpose. You may not copy, modify, or create derivative works from the service except as allowed by law.
13. Third-party services
parq relies on Stripe (payments), Twilio (text messaging), Supabase (database and authentication), and Vercel (hosting). We are not responsible for the availability, content, or acts of third-party services, and your use of them may be subject to their own terms.
14. Disclaimers
parq is a payment service. We do not operate, secure, patrol, or maintain the lots. The service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.
15. Limitation of liability
To the maximum extent permitted by law, parq is not liable for indirect, incidental, special, consequential, or punitive damages, or for damage to or theft of vehicles or their contents. Our total liability for any claim relating to the service is limited to the greater of the amount you paid parq for the parking session or sessions giving rise to the claim, or US $100.
16. Indemnification
You agree to indemnify and hold harmless parq and its owners, officers, and employees from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your vehicle, or your violation of these Terms or of any law or third-party right.
17. Dispute resolution and arbitration
Please read this section carefully; it affects your legal rights. You and Vignelli Technik LLC agree to resolve any dispute arising out of or relating to these Terms or the service through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court. Arbitration is on an individual basis only: you and parq waive any right to bring or participate in a class, collective, or representative action. Either party may still bring an individual claim in small-claims court if it qualifies. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing compliance@parq.live with your mobile number and a statement that you opt out; opting out does not affect the rest of these Terms.
18. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. For any dispute not subject to arbitration, you and parq agree to the exclusive jurisdiction and venue of the state and federal courts located in Hidalgo County, Texas.
19. Termination
You may close your account at any time; see the Privacy Policy for how deletion works. We may suspend or terminate an account for violations of these Terms, fraud or chargeback abuse, plate spoofing, non-payment, or security reasons.
20. Changes to these terms
We may update these Terms from time to time. If a change is material, we will give prominent notice. Your continued use of parq after a change takes effect means you accept the updated Terms.
